Privacy Policy

This policy describes how we actually work today. It is written by the studio, not by a law firm, and is subject to refinement — if anything here is unclear or you need it in a different form for your district's paperwork, ask us and we will answer plainly.

DurkinPhotos LLC provides event, sports, and portrait photography. This policy explains how we handle personal information on durkin.photos and in the event photography services we provide.

Information we collect

When you contact us, we collect the information you provide, such as your name, email address, organization, requested service, event date, referral source, and message. Our forms use bot protection that processes technical browser signals to help prevent abuse.

When we photograph an event, we create photographs of participants, coaches, staff, spectators, and performances. Photographs may include technical metadata and may be associated with information the event host provides, such as a name, jersey number, team, or session.

When you place an order, we collect information needed to process and fulfill it. Payment-card information is handled directly by our payment processor; we do not store card numbers.

When you visit our site or use a gallery, we and our providers process the technical information needed to operate, secure, and control access to it. We may use necessary cookies and similar security technologies. We use Cloudflare Web Analytics on our marketing site, which measures page performance and traffic without cookies, fingerprinting, or cross-site tracking. We do not use advertising pixels, session-recording tools, or behavioral analytics trackers.

Our marketing site is intended for parents, schools, leagues, and other adults. We do not ask children to submit personal information through it.

How we use information

We use information to respond to inquiries, prepare and perform photography services, deliver galleries and orders, send transactional messages, provide customer support, keep required business records, and protect our services from fraud and misuse.

We may use photographs to promote DurkinPhotos only when we have documented authorization for that use. For identifiable youth photographs, the authorization must come from the contracting event host and cover the intended promotional use.

We do not sell or rent personal information, use it for cross-context behavioral advertising, or use photographs of minors to train machine-learning models.

Youth photographs

We work through the school, club, league, or other event host. We ask the host to provide the photography restrictions and opt-outs that apply to the event, and we honor them. Youth galleries are private by default and use access controls selected for the event.

Face matching is disabled by default for youth events. We may enable a feature that helps find similar photographs only within a single event when the event host has documented its approval and applicable notice and consent requirements have been satisfied. We do not use it to match people across events.

A parent or guardian may request removal of their child’s photographs by emailing privacy@durkin.photos or using the removal request in an event gallery. After we verify the request, we aim to complete it within five business days and prioritize safety-related requests. Deletion applies to systems under our control; we cannot recall copies already downloaded, purchased, or delivered to the event host.

How we share information

We share information only as needed to provide our services. This includes service providers that help us host and secure our website and galleries, process payments, send transactional email, and store or deliver photographs. Current providers include SansPost, Cloudflare, Stripe, and Resend. We also share commissioned photographs with the contracting event host.

We may disclose information when required by law or valid legal process, to professional advisers under confidentiality obligations, or in connection with a business sale or reorganization.

Retention and security

Camera originals are deleted 180 days after an event. Delivered gallery images may remain available while the gallery is active. We keep contracts, invoices, and other business records as required or reasonably needed for tax, accounting, and legal purposes.

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system can guarantee absolute security.

Your choices and contact

You may ask us to access, correct, delete, or obtain a copy of personal information we hold about you, subject to applicable law and legitimate limits. Contact us at privacy@durkin.photos. We may need to verify your identity before acting on a request. If we deny a request, you may appeal by emailing the same address with “Appeal” in the subject line.

Changes to this policy

We will post updates here and change the date below. For material changes to how we handle youth photographs, we will notify the affected event host when appropriate.
